However, if you swerve to avoid debris in the road and cause an accident, you likely have not violated your duty of care. You did what a reasonable person probably would have in the same situation. And it’s likely no one can sue you for any damages that resulted.

Now, you must show that the breach in the duty of care led to your injuries. Insurers work hard to show that your injuries resulted from some other unrelated cause.

For example, you might have injuries you experienced from another accident in the past. The insurer may say that caused your current injuries, and not their customer’s negligent behavior.
