It’s not uncommon for people involved in a car wreck, fall, or worksite accident to suffer a concussion. Most of the time concussion symptoms resolve in a few weeks or months, but it’s important to remember a concussion is a type of traumatic brain injury (commonly referred to as a TBI).
Some people – the “miserable minority” – can sustain even a mild traumatic brain injury and end up suffering from chronic TBI symptoms such as affective mood disorder, cognitive impairment, headaches, light and/or noise sensitivity, etc. All head injuries should be taken very seriously.
We represented a client who fell, struck his head, and was knocked unconscious when the steps to his rental unit collapsed. Photographs we obtained demonstrated significant deterioration and that a reasonable inspection of the premises would have alerted his landlord to the presence of the dangerous condition. In fact, we were able to show most of the premises was in a general state of disrepair. This gave the impression our client’s landlord clearly put profit over the safety of their tenants.
Sometimes a severe TBI is apparent right out of the gate. This client had been to the ER twice with headaches, confusion, dizziness, blurred vision, concentration issues and other symptoms. When I first spoke to him, his symptoms had worsened. He was having significant difficulties with his speech including difficulty finding his words. He also developed a pronounced stutter. Our client was frustrated and, frankly, terrified as anyone would be under those circumstances.
