About Grocery & Retail Store Injury Claims
What should you do if you are injured in a grocery or retail store?
You hear all the time about people slipping and falling at grocery stores. It’s a relatively common occurrence. You may have even seen videos on TV or YouTube or heard about the results of a case, but you never really hear about what to do if it happens to you.
Always Focus on Your Health First
Grocery store accidents often lead to troubling injuries. Sometimes the injuries are readily apparent such as a fractured or broken bone. Other times they lead to injuries that require imaging to confirm such as a torn rotator cuff or torn meniscus.
It is also not uncommon for people to strike their head on the ground when falling, leading to a concussion or more severe traumatic brain injury.
Other times you may think you’ve only suffered a sprain or bruising and that you’ll be fine in a few days.
Other times you may think you’ve only suffered a sprain or bruising and that you’ll be fine in a few days. That doesn’t always happen though.
The truth is you don’t always know exactly what type of injuries you sustained in the moments following a Dallas grocery store accident.
Your first inclination will likely be to feel ashamed and embarrassed. You may want to get up, brush it off, and pretend you’re just fine.
Don’t feel rushed to get to your feet as doing so can often lead to further injuries. Don’t minimize the trauma the fall caused you.
Stay down and as still as possible until you get your wits about you. If you think you broke a bone or tore something, you shouldn’t move until medical personnel arrives on-site or you might make your injuries worse.
Attempt to move only as soon as you’re confident you can safely do so. If your injuries seem severe, simply hold still, and let others help you. Tell them not to move you and to call emergency help if you think your injuries are serious.
Make Your Report to the Store Manager
You want the on-duty manager to observe the scene of your accident as soon as possible. Ask an employee or nearby customer to help you contact one.
Grocery stores require managers to document slip and fall accidents. They’ll write their version of what happened. They may ask that you provide a written statement of what transpired.
Try to get a copy from the manager. If you can’t get one, don’t worry. Your personal injury attorney can secure a copy later if necessary. Consider snapping a photograph of the report before you submit it if possible.
Document Your Grocery or Retail Store Accident
Smartphones come in amazingly handy for grocery store accident claims. You should gather thorough evidence if it is possible for you to safely do so.
To win your legal claim it is likely you will eventually need to demonstrate that the store had actual or constructive knowledge of a dangerous condition.
This means you should take lots of pictures of the accident scene. Shoot a video if you’re able to. Get the name, address, and phone number of witnesses.
Try to get the witnesses to make brief statements of anything they noticed. Also, try and write down the names of all store employees and managers you encounter.
Especially helpful evidence includes anything that shows the store had knowledge of the condition that led to your grocery store accident, yet they failed to do anything about it.
For example, another customer almost slipped and fell earlier or another employee saw the spill and walked past it. Don’t hold back at all. You really can’t overdo it when collecting evidence. The worst that happens is you don’t have to use it.

Can you get a settlement if you fell because water was on the floor?
Maybe. Your right to recover damages in a premises liability claim is influenced by several factors. First, you need to establish you had a legal right to be at the grocery store as your classification status will impact the duties owed to you.
Next, you need to establish the water on the floor constituted a dangerous condition. Third, if it was a dangerous condition, you must establish the grocery store (or one or more of its employees) knew of the water on the floor OR should have known of the water on the floor.
Finally, you will have to establish the slip and fall was the proximate cause of the injuries you sustained. This involves the “mechanism of injury”.
Remember: The Dallas retail or grocery store will likely argue you that you were also responsible (comparatively negligent) for not avoiding the water, i.e. that the dangerous condition was open and obvious. You can still recover damages as long as you were not more than 50% responsible for what happened. Your percentage of fault impacts your recovery.
