Proposed Texas House Bill 4806:
- Eliminates access to “letter of protection” healthcare for victims without insurance or who can’t afford deductibles—shifting costs to taxpayers and capping care at below-market rates.
- Rewrites definitions of physical pain and mental anguish, making it nearly impossible for most injured Texans to recover these damages.
- Wipes out long-established damages for physical impairment and disfigurement, leaving the most seriously injured with no compensation for loss of enjoyment of life or disfiguring trauma.
- Strips away compensation for loss of companionship and consortium in wrongful death cases-leaving no compensation for the true loss of the wife/husband and parent/child relationship.
- Caps future medical expense recovery at 300% of Medicare, even in cases of lifelong catastrophic injury like brain damage.
