What is “Common Carrier” Law and What’s it Got to do with Public Transportation?

Take a look at these plain-English answers to some of the most common (and challenging) questions motorcycle accident victims ask:
Will I have to go to court?
Not usually. Litigation is expensive and time-consuming. In the vast majority of cases a compromise settlement is reached before the necessity of a trial.

A large part of this depends on the skill of the lawyer you hire. More experienced and skilled personal injury lawyers are far more likely to resolve your claim outside of court than inexperienced ones.
What happens if a poorly maintained road caused my injuries?
Yes, sometimes the road, not a person, is responsible for your injuries. For example, you’re driving at the speed limit when you hit a deep pothole.

Attorney Settles Spine Injury Car Wreck in Sanger TX for $650,000

$650,000 settlement for cervical spine injury requiring surgery after car wreck in Sanger, TX. Fantastic result for client with disc herniation.
Our client was driving south in the left lane on I35. A motorist in the course and scope of his employment was pulling a trailer and was in the right lane traveling in the same direction. He failed to properly secure and monitor the trailer and was also speeding. As a result the trailer swayed into our client’s lane and collided with her car.

Comments from Attorney Shane Mullen: Our client was already on disability for low back injuries that required her to undergo lumbar spine surgery. The wreck at issue aggravated her low back condition and injured her neck. In fact, she first complained of neck pain at the emergency room. Our injury law firm assisted her in obtaining the services of a well-respected doctor and was able to convince the physician to delay billing […]

When Do Employers Have Liability in Car Accident Cases?

If an employee of a company hits you, who is liable? The company or the employee? Find out in this post from Mullen & Mullen.
Someone hits and damages your car, and puts you in the hospital for a few days.

Only this time, there’s an added wrinkle: the driver of the other car was an employee of a company.

Who’s liable? The employee? The company? Both?

Well, it gets more complicated. Learn how this situation could shake out:
Generally, the Company Answers for the Employee’s Mistakes
Companies have a lot more money than employees. They also likely have much better insurance coverage. And it is, of course, easier for the company to afford the insurance.

A legal principle called “respondeat superior,” which means “the superior must answer” basically says those who are most able to handle risk must bear it. And practically speaking, that means the company is generally responsible.
But of Course, There’s Exceptions to Company Responsibility
A […]

Attorney Settles Sprain/Strain Injury Car Accident in Dallas, TX for $30,001

$30,001 gross settlement for car accident in Dallas, TX. Outstanding recovery by attorney for client with back and neck sprain/strain injuries.
Our client was a passenger in a car traveling westbound on LBJ Freeway in Dallas, TX near Coit Rd. Another motorist lost control of her vehicle and spun out. Her automobile crossed multiple lanes of traffic and crashed into our client knocking his car into a wall.

Comments from Attorney Joseph Morrison: This was a significant car wreck. Our client went to the emergency room with initial complaints of neck pain, back pain, right knee pain, and some abdominal pain from the seat belt. We assisted him in locating a clinic that would delay billing until the conclusion of his car accident injury case so he wouldn’t get stuck paying expensive co-pays and deductibles on a limited budget while recovering from injuries that were not his fault.

Remember: Venue is a factor that your personal injury attorney should […]

Pedestrian Injury Car Accident in Frisco, TX Settles for $55,003

$55,003 settlement for pedestrian injury car accident in Frisco, TX. Outstanding recovery by attorney for client injured by driver that fled the scene.
Our client was walking south in a dirt parking lot while a motorist was traveling west in that same lot. He stepped out between two cars and stopped to let the vehicle pass. Suddenly, without warning, the motorist turned and struck him in the leg before striking another automobile. He was essentially pinned between the two cars. The at-fault driver exited his vehicle, fled the scene, and was later arrested.

Comments from Attorney Joseph Morrison: It is infuriating when a motorist causes a wreck and then flees the scene like a coward. It is deeply troubling that a person could injure an innocent victim and run away without rendering aid. Needless to say, I let the insurance adjuster know early on in the case that I was going to hold his […]

Attorney Settles 18-Wheeler Accident Injury in Dallas, TX for $36,000

$36,000 recovery for 18-Wheeler accident in Dallas, TX involving whiplash. Fantastic result by attorney significantly above client’s incurred medical bills.
Our client was traveling eastbound on Singleton Blvd. in Dallas, Texas with his family members also in the car. They came to a stop at a red light. When the light turned green they proceeded through the intersection. The driver of a commercial 18-Wheeler disregarded his red light and collided into them. The impact tilted our client’s automobile up and then slammed it back down to the ground. Our client did not go to the hospital but began to experience discomfort a few days after the truck wreck.

Comments from Attorney Joseph Morrison: An accident with an 18-Wheeler is an absolutely terrifying experience. They are huge vehicles that can cause massive damage and loss of life. Clients routinely tell me they did not feel pain immediately after their collision. This is because their adrenaline is off the charts. However, […]

What is Personal Injury Protection (PIP) Insurance & Should You Have It?

Do you need to carry personal injury protection insurance? What is it anyway? While not common, it’s quite helpful in a few situations.
Believe it or not, personal injury protection (PIP) insurance was designed to reduce the number of lawsuits filed. It’s also called “no-fault insurance.” That simply means the insurance kicks in and works regardless of who has fault, and to what extent, in a motorcycle accident (or any other kind of car accident).

In other words, it’s simply available when you need it. Texas does not require you to have PIP. However, insurers must give you $2,500 as part of your policy if you don’t specifically reject PIP. You can pay increased premiums for higher PIP limits.
What Does Personal Injury Protection Cover?
PIP actually covers quite a bit. Broadly defined, it covers some of the more common economic expenses that arise from a car accident. These include:

Medical care costs
Up […]

Attorney Settles Soft Tissue Injury Car Wreck in Dallas, TX for $60,000

$60,000 settlement for soft tissue injury car wreck in Dallas, TX. Fantastic recovery by attorney for client with pre-existing degenerative disc disease.
Our client, who formerly served in the United States Army, was driving west on interstate 30 in the left lane near 2nd Avenue. Traffic started slowing due to congestion. The at-fault driver was not paying attention and rear-ended our client’s automobile. They both pulled over to the right shoulder and waited for law enforcement to arrive. The Texas Peace Officer’s Crash Report, arising from the car accident, placed 100% blame on the inattentive motorist.

Comments from Attorney Joseph Morrison: I really enjoyed representing this client. He went to his primary care physician (PCP) following the car wreck and complained of neck and back pain and contacted our office shortly thereafter. Our attorneys assisted him in locating a rehabilitation clinic that would delay billing for his medical services until the conclusion of his […]
